Again, Court of Appeal dismisses suit against Obi

Peter Obi has gained legal victory in the Abuja Court of Appeal regarding the suit filed by the Allied Peoples Movement (APM) to disqualify him from the February 25 Presidential election.

In the appeal marked: CA/ABJ/CV/1414/2022, the party had approached the court, arguing that the INEC ought not to have accepted Obi as a valid candidate for the Presidential poll.

APM said this was in because Obi defected from the Peoples Democratic Party (PDP) to the Labour Party (LP) in order to contest in the Presidential poll, which they argued was in violation of sections 77(2) and (3) of the Electoral Act, 2022.

They also claimed that the LP had already sent a list of its registered members to the INEC before Obi joined the party. For this reason, they appellant claimed that Obi had no right to be recognized as the LP presidential candidate.

APM further urged the court to overrule the verdict of the Federal High Court which dismissed the initial suit filed for the same purpose.

Nevertheless, the three-member panel of justices unanimously set aside the suit, stating that it had no grounds.
